Notice to people we analyse

This notice is for people who appear in aiwrness analyses without being our customers or users. If you have an account with us, the Privacy Policy covers you as well.

1. Why you might appear

1.1 What the service does

aiwrness measures how AI assistants and search services answer questions about brands, products and markets. Our customers — businesses, agencies and independent professionals — configure the questions. We send those questions to AI and search services, and record and analyse what comes back.

1.2 How your information enters

You may appear because:

  • an AI or search service named you in an answer to a customer’s question;
  • a source cited in an answer — a news article, a forum thread, a public professional profile, a video page — refers to you;
  • you are a self-employed professional or creator whose public professional profile a customer chose to track; or
  • a customer mentioned you in the material they supplied.

We do not collect this information from you, and in most cases you will not have been in contact with us.

2. What we process and why

2.1 Categories

Names and professional aliases; links to public profiles, pages and images; stated affiliations and roles; statements generated by AI services that mention you; passages, titles and links from cited sources; classifications we derive, including language-tone classifications; dates, counts and identifiers used to organise the records.

2.2 Source

AI and search services responding to a customer’s configured question, publicly accessible web sources cited by those services, and material a customer supplied.

2.3 Purpose

To answer the questions a customer configured, to measure how brands and products are represented in AI answers, and to organise those results into reports for that customer.

2.4 Important limits

Tone and sentiment features classify the language of a text. They do not measure your actual emotions, beliefs or intentions, and must not be presented as doing so.

Statements produced by AI services about you may be false. We do not write, verify or endorse them. A record in our system is evidence that a model produced a statement at a particular time — not evidence that the statement is true. Our customers are contractually required to check outputs before relying on or republishing them.

Our customers are contractually prohibited from using the service for recruitment, employment, workplace monitoring, credit, insurance, housing, social scoring or similar decisions about individuals.

3. Who is responsible

3.1 Roles

For analyses a customer configures, that customer decides the purposes and is the controller. We act on its instructions as processor. That customer is responsible for having a lawful basis and for informing you, including any reliance on the disproportionate-effort exception in Article 14(5) GDPR.

We publish this notice as a general information measure supporting that duty. It does not replace it, and publishing it does not by itself exempt any customer from informing you individually.

3.2 Where we decide

We are the controller for our own processing, including account administration, billing, security and the public free report described in the Privacy Policy.

3.3 Legal basis

Where a customer instructs the processing, its lawful basis applies — normally its legitimate interest in market and competitive analysis. Where we process as controller, we rely on our legitimate interest under Article 6(1)(f), assessed and documented, or another basis stated in the Privacy Policy.

4. Your rights

4.1 What you can ask for

Access to the data concerning you; correction of inaccurate data; erasure; restriction of processing; and objection under Article 21 GDPR to processing based on legitimate interests, for reasons relating to your particular situation.

4.2 How to ask

Write to [email protected]. You do not need an account, a paid subscription or any particular form. Tell us the name, profile or item concerned and, if you can, where you saw it. We use proportionate identity checks and do not routinely ask for identity documents.

We normally reply within one month. Where the request concerns a customer’s workspace, we tell that customer without undue delay and identify it to you where we lawfully can, so you can also address it directly.

4.3 If your request is not acted on

Where your objection, correction or erasure right is valid and the relevant customer does not act within a reasonable period, where we cannot reach that customer, or where you are affected across several customers, we act ourselves: we remove or restrict the records concerning you and stop including you in further analyses.

Every request is handled by a person. There is no automated form and no self-service button — we read what you send, check it, and tell you what we did.

We keep only the minimum record needed to keep that exclusion working, tell affected customers that it has been applied and its scope, and lift it if the basis ceases. We do not use those records for anything else.

4.4 What we cannot do

We cannot remove content from independent websites, from the underlying systems of a third-party AI model, or from copies a customer has already exported. For those, you need to approach the publisher or the AI provider directly. Suppression in aiwrness stops us from processing you; it does not change what a model says elsewhere.

4.5 Complaints

You may complain to Portugal’s CNPD or to the supervisory authority for your habitual residence, place of work or the alleged infringement. You do not have to contact us first. Judicial remedies remain available.

5. Retention and recipients

5.1 Retention

Records live inside a customer’s workspace and follow the retention rules in Section 9 of the Privacy Policy: during the service, then a retrieval period, then active deletion, then backup expiry. A valid erasure request is not subject to those waiting periods.

5.2 Recipients

The AI, search, infrastructure and communication services listed in the provider schedule, and the customer whose workspace holds the records. Some of those services operate outside the EEA; Section 8 of the Privacy Policy explains the safeguards.
